3. General Principles
3.1 What data do we collect from you and from whom do we receive it?
We primarily process personal data that you provide to us or that we collect during the operation of our website. In some cases, we may also receive personal data about you from third parties. These may include the following categories:
Personal identification data (name, address, date of birth, etc.)
Contact data (mobile number, email address, etc.)
Financial data (e.g., account information)
Online identifiers (e.g., cookie ID, IP addresses)
Location and traffic data
Audio and visual recordings
Special categories of data (e.g., biometric data or health information)
3.2 Under what circumstances do we process your data?
We treat your data confidentially and in accordance with the purposes defined in this privacy policy. We ensure transparency and proportionality in our processing activities.
If we are exceptionally unable to adhere to these principles, the processing may still be lawful if a justification exists. Possible legal grounds include:
Your consent
The performance of a contract or pre-contractual measures
Our legitimate interests, provided they do not override your interests
3.3 How can you withdraw your consent?
If you have given us consent to process your personal data for specific purposes, we will process your data within the scope of that consent, unless another legal basis applies.
You can withdraw your consent at any time by sending an email to the address listed in the imprint. This does not affect the lawfulness of processing based on consent before its withdrawal.
3.4 In which cases can we share your data with third parties?
a. General Principle
We may need to use third-party services or affiliated companies and commission them to process your data (so-called processors). Recipient categories include:
Accounting, fiduciary, and auditing firms
Consulting firms (legal, tax, etc.)
IT service providers (web hosting, support, cloud services, web design, etc.)
Payment service providers
Providers of tracking, conversion, and advertising services
We ensure that these third parties and affiliated companies comply with data protection requirements and handle your personal data confidentially.
In some cases, we may also be obligated to disclose your personal data to authorities.
b. Visiting Our Social Media Channels
We may have embedded links to our social media channels on our website. These are typically recognizable by icons. If you click on one of these icons, you will be redirected to our social media channel.
In doing so, the social media provider will know that you accessed their platform from our website. The provider may use this data for its own purposes. We have no knowledge of the content or use of the transmitted data by the providers.
c. Transfer Abroad
In the context of processing, your personal data may be transferred to companies abroad. These companies are subject to the same data protection obligations as we are. Transfers can occur worldwide.
If the level of data protection is not equivalent to that in Switzerland, we conduct a prior risk assessment and contractually ensure equivalent protection (e.g., through the new EU standard contractual clauses or other legal safeguards). If the risk assessment is negative, we implement additional technical measures. The EU standard contractual clauses can be found here: https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_de
3.5 How long do we store your data?
We retain personal data only for as long as necessary to fulfill the purposes for which they were collected.
Data collected during your visit to our website are stored for twelve months, except for analytics and tracking data, which may be stored longer.
We retain contractual data longer due to legal requirements. Business correspondence, concluded contracts, and accounting records must be kept for up to 10 years. Once no longer needed for service delivery, these data are restricted and used only for accounting and tax purposes.
3.6 How do we protect your data?
We store your data securely and take all reasonable measures to protect it from loss, unauthorized access, misuse, or alteration.
Our contractors and employees who access your data are bound by confidentiality and data protection obligations. In some cases, we may need to forward your requests to affiliated companies. Your data will be handled confidentially in all such cases.
Our website uses SSL encryption in combination with the highest level of encryption supported by your browser.
3.7 What rights do you have?
a. Right to Information
You may request information about the personal data we store about you at any time. Please send your request along with proof of identity to team@atlass.ch.
You also have the right to receive your data in a common file format if we process your data automatically and if:
You have consented to the processing; or
You disclosed the data in connection with a contract.
We may restrict or refuse access or disclosure if doing so conflicts with our legal obligations, legitimate interests, or the interests of third parties.
Your request will be processed within the statutory 30-day period. This may be extended due to high request volumes, legal or technical reasons, or a need for additional details. You will be notified in time in writing.
b. Deletion and Correction
You may request deletion or correction of your data at any time. We may deny the request if legal obligations require longer or unchanged retention, or if another justification applies.
Please note that exercising your rights may conflict with contractual agreements and impact service delivery (e.g., early termination or costs).
c. Legal Recourse
If your personal data are being processed, you have the right to enforce your rights in court or to lodge a complaint with the competent supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC): https://www.edoeb.admin.ch
